1Push. and its affiliates and subsidiaries (collectively, “1 Push” or “we” or “us”) is committed to protecting privacy of your personal data. This Privacy Policy applies to those who visit the websites owned and operated by 1Push, download any downloadable software, install any mobile applications, and/or use the Company’s products and services offered at www.1push.co.za (collectively, the “1Push Service”).This Privacy Policy describes how 1Push collects, uses, shares and secures the personal data of the users of 1Push Service (the “User(s)” or “you” or “yours”, as applicable). It also describes your choices regarding use, access and correction of your personal data. The capitalized terms used in this Privacy Policy but not defined herein shall have the same meaning assigned to them in 1Push Terms of Use (https://1push.co.za/terms) (the “Terms”).If you have questions or complaints regarding our Privacy Policy or practices, please contact us at support@1push.co.za. Our Privacy Policy may be modified from time-to-time. We will alert you that changes have been made by indicating on our Privacy Policy the date it was last updated. If we make any material changes, we will notify you by email or by means of a notice on this website prior to the change becoming effective. 1. What is Personal Information?

Personal Information is personally identifiable information such as your name, telephone number, email address and any other non-public information about you that is associated with or linked to any of the foregoing information. Personal information does not include aggregate information, which is general user data we collect about the use of 1Push. Our Privacy Policy does not restrict or limit our collection and use of aggregate information.

2. What Personal Information Does 1Push Collect?

2.1 Information you provide for the use of technology

- Registration and Profile Information. When you create an account, we may collect your personal information such as your first and last name, email address and mobile phone number. If you want to add a contact’s name to your account, we collect the contact’s name, email address, and mobile phone number. We may collect billing information when you sign up for the Premium service.

- Geolocation. We collect your unique user identifier and your location through GPS while the application is running and also; if allowed by you, in the background even when the application is closed in order to obtain your location for the purposes of providing the 1Push Service. We collect the location of your designated Location Alerts in order to provide notifications and alerts when you or a nearby user sends out a new alert. We also use your location when you choose to send out an alert to nearby users with your location. If you turn off location sharing we will not share your location with other users, and you will not be able to send out or receive alerts to nearby users; however, while you are logged in to your account. We maintain location information only so long as is reasonable to provide the Service and then delete the location data.

2.2 Automatically collected information through the use of technology:

When you use the 1Push Service, we and our business partners may collect certain information about your computer or device through technology such as cookies, web beacons, log files, or other tracking/recording tools. The information we collect through the use of tracking technologies includes, but is not limited to, IP address, browser information, referring/exit pages and URLs, click stream data and how you interact with links on the website, mobile app, the 1Push Service, domain names, landing pages, page views, cookie data that allows us to uniquely identify your browser, browsing behavior on our site, mobile device type, mobile device IDs or other persistent identifiers, and location data collected from your mobile device. Some or all of this data may be combined with other personally identifying information described above.

We use this information to:

• Remember information so that you will not have to re-enter it during your visit or the next time you use the app

• Provide custom, personalized content and information

• Monitor the effectiveness of our Service and our marketing campaigns

• Monitor aggregate metrics such as total number of visitors, users, traffic, and demographic patterns

• Diagnose or fix technology problems reported by our Users or engineers that are associated with certain IP addresses or User IDs

• Automatically update our mobile application on your system and related devices

2.3 Children’s Privacy:

The service is intended to be used by children under 13 only with parental approval. If a parent wishes to add a User who is under 13 to the Family account, the parent must send 1Push Parental Consent via email. The child’s personal information will be shared with other members of the family account. 1Push may then use the child’s personal information as described in this Privacy Policy. However, we do not use or share personal information collected from the accounts of children under 13 for marketing or advertising purposes, or permit our third party partners to collect and use such information for advertising purposes.

3. How Does 1Push Use Personal Information?

Generally, 1Push collects, stores, uses and discloses information to enable us to:

- provide the 1Push service;

- create your account;

- identify you as a user;

- respond to your inquiries and emails;

- improve the application;

- send you administrative and service related communications;

- send you newsletters, surveys, offers, and other promotional materials;

- monitor the effectiveness of our Service and our marketing campaigns.

If you are an individual from the European Economic Area (EEA), we use your Personal Information, we may process your personal data on one or more of the following legal grounds: (i) because processing is necessary to perform a contract with you, such as to deliver the 1Push Service; (ii) to comply with our legal obligations; (iii) because processing is necessary for purposes of our legitimate interest or those of any third party recipients that receive your personal data, provided that such interests are not overridden by your interests or fundamental rights and freedoms. We may also process your Personal Information based on your consent where you have expressly given that to us.

3.1 Third Party Analytics

We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the 1Push Service. Tools like Appsflyer, Flurry and Firebase collect information sent by your browser or mobile device, including the pages you visit, your use of third-party applications, and other information that assists us in analyzing and improving the Service. Anonymous aggregate statistics that do not personally identify the Users will be kept and used by us for various purposes including analysis and reporting of usage patterns.

4. How Does 1Push Share Your Personal Information?

We share your personal information, including your name and location data, with others within your 1Push circle specified radius when you choose to send an alert.

Any information or content that you voluntarily post to our App Store and Google Play Store, or our social media pages will automatically be available to the public. We may publicly post your reviews and comments online.

From time to time, we may employ third parties to help us provide or improve the 1Push Service. These third parties, such as our analytics or hosting provider, may have limited access to databases of user information or registered member information solely for the purpose of helping us provide or improve the Service and they will not be able to use the information about our members or visitors for any other purpose. We may disclose personal Information in some other limited circumstances, but we will specifically describe them to you when we collect the information, such as in the terms of use for a new service or by revising this Privacy Policy.

We may, and you hereby authorize us to, disclose your Personal Information (including messages) to a third party without your consent: if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other website users, or anyone else (including the rights or property of anyone else) that could be harmed by such activities, in connection with any legal investigation, when we believe in good faith that such disclosure is required by and in accordance with the law or to respond to subpoenas or warrants served on 1Push, to any third party with your prior consent to do so.

Except as set out in this Privacy Policy, your personal Information will not be used for any other purpose without informing you first by updating this Privacy Policy. Except for the limited disclosures described in this Privacy Policy, we do not sell customer lists or any personal information to third parties, and we will take all possible measures to keep your email address private to keep your email address private.

5. How Does 1Push Protect Your Personal Information?

The security of your Personal Information is important to us. We use all commercially reasonable efforts to store and maintain your Personal Information and location information in a secure environment and have implemented reasonable procedures designed to limit unauthorized access, use or disclosure of your Personal Information. We encrypt the transmission of your location-based data using secure technologies to preserve the integrity and security of all information we collect. Despite these measures, you should know that 1Push cannot fully eliminate security risks associated with Personal Information. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. Please also remember, that to protect the communications that have taken place in the app, never give out your password.

6. How Long We Retain Your Personal Information:

We will retain your Personal Information for as long as is needed to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. For personal information that we process on behalf of our Users, we will retain such personal information in accordance with the terms of our agreement with them, subject to applicable law.

7. How Can I Update User Access or Deactivate my Account?

If your personal information changes, or if you no longer desire the 1Push Service, you may email us at support@1push.co.za to deactivate your account. You may also correct, update, or amend your personal information in your profile settings within the 1Push app or by emailing us. Removing 1Push from your mobile device will not delete the personal information that has been retained about you. Your user content can be deleted permanently by emailing a request to support@1push.co.za.

8. How Can I Manage Communication with 1Push?

You may "opt out" of receiving marketing or promotional emails from us by following the instructions in those emails or by emailing us at support@1push.co.za. If you opt out, we may still send you non-promotional emails, such as emails about your accounts or our ongoing business relations. To opt out of push notifications, please edit settings within the app or change your settings at the device level.

9. What Laws are 1Push Governed by?

1Push is a global company, based in South Africa. If you are a user accessing 1Push from any other region with laws or regulations governing personal data collection, use, and disclosure that differ from South African laws, please be advised that through your continued use of 1Push, which is governed by the South African law, 1Push Privacy Policy, and Terms of Service, you are transferring your personal information to South Africa and you consent to that transfer.

What is a Subject Access Request?

This is your right to request a copy of the information that we hold about you. If you would like a copy of some or all your personal information, please contact us at support@1push.co.za. We will respond to your request within thirty days of receipt of the request. We want to make sure your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate by support@1push.co.za. We will consider your request in accordance with applicable laws. To protect your privacy and security, we may take steps to verify your identity before complying with the request

Objections to processing of personal data

It is your right to lodge an objection to the processing of your personal data if you feel the “ground relating to your particular situation” apply. The only reasons we will be able to deny your request is if we can show compelling legitimate grounds for the processing, which override your interest, rights and freedoms, or the processing is for the establishment, exercise or defense of a legal claim. To protect your privacy and security, we may take steps to verify your identity before complying with the request.

Data Portability

It is also your right to receive the personal data which you have given to us, in a structured, commonly used and machine-readable format and have the right to transmit that data to another controller without delay from the current controller if:

(a) The processing is based on consent or on a contract, and

(b) The processing is carried out by automated means.

Your Right to be Forgotten

Should you wish for us to completely delete all information that we hold about you for, contact us at support@1push.co.za. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations. You also have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority. If you feel that your personal data has been processed in a way that does not meet the GDPR, you have a specific right to lodge a complaint with the relevant supervisory authority. The supervisory authority will then tell you of the progress and outcome of your complaint
